GENERAL TERMS AND CONDITIONS

§ 1 Scope of Application, Customer Information
The following General Terms and Conditions (GTC) govern the contractual relationship between Raisch GmbH and consumers and businesses who purchase goods via our shop at www.classicbike-raisch.de. We do not recognise any terms and conditions that conflict with or deviate from our General Terms and Conditions. The contract language is German.

§ 2 Conclusion of Contract

  1. The offers on the internet constitute a non-binding invitation to you to purchase goods.
  2. You may add one or more products to your shopping basket. During the ordering process, you will enter your details and preferences regarding payment method, delivery options, etc. It is only by clicking the ‘Order’ button that you submit a binding offer to conclude a contract of sale. You may also place a binding order by telephone or fax. The confirmation of receipt of your order, sent immediately by email or fax, does not constitute acceptance of the offer to purchase.
  3. We are entitled to accept your offer within 2 working days by sending an order confirmation by email. If the period referred to in the first sentence expires without result, your offer shall be deemed to have been rejected; in other words, you are no longer bound by your offer. In the case of an order placed by telephone, the contract of sale is concluded when we accept your offer immediately. If the offer is not accepted immediately, you are no longer bound by it.


§ 3 Customer information: Storage of your order details
We will store your order along with details of the contract concluded (e.g. type of product, price, etc.). However, you do not have access to your previous orders via the internet. We will send you the Terms and Conditions, but you can also access them at any time via our website. If you wish to save the product description on our shop page for your own purposes, you can, for example, take a screenshot at the time of ordering or, alternatively, print out the entire page.

§ 4 Customer information: Correction notice
You can correct your entries at any time using the delete key before submitting your order. We will inform you of further correction options as you progress through the ordering process. You can also terminate the ordering process completely at any time by closing the browser window.

§ 5 Retention of title
The purchased item remains our property until full payment has been made.

§ 6 Warranty
Statutory rights relating to liability for defects apply to our goods.

§ 6.1 Addendum: Dr Jekyll & Mr Hyde Exhaust Systems
6.1.1 The statutory liability for defects applies, subject to the following provisions.
6.1.2 Note: Damage caused by the customer’s improper actions or actions contrary to the terms of the contract – for example, during installation, assembly, connection, operation or storage – does not give rise to any claim against Jekill & Hyde. Whether an action is improper or in breach of contract is determined in particular by the manufacturer’s specifications.
6.1.3 In the event of obvious defects or damage caused during transport, the customer is requested to report these to Jekill & Hyde without delay. Thiswill assist Jekill & Hyde in any subsequent claims against its own supplier. If the customer is a consumer, failure to report such defects immediately shall, of course, have no effect on their warranty claims.

§ 7 Commercial Jurisdiction
The exclusive place of jurisdiction for all disputes arising from this contract is our registered office, provided you are a trader.
